General Terms and Conditions of Sale

GENERAL PROVISIONS
These conditions are valid exclusively between the company PARLUX SpA with registered office in via Goldoni, 10/12 – 20090 Trezzano s/N (MI) VAT number 03790230159, share capital Euro 560,000.00 fully paid, Chamber of Commerce Milan 971926, hereinafter referred to as 'PARLUX'' and any person who makes online purchases on the website www.parluxstore.it hereinafter referred to as ''CUSTOMER''. These conditions may be subject to changes and the date of publication of the same on the site is equivalent to the date of entry into force.

These conditions govern purchases made on the website www.parluxstore.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and Legislative Decree 70/2003 on electronic commerce.

SUBJECT OF THE CONTRACT
With these general conditions of sale, PARLUX sells and the CUSTOMER purchases remotely the products indicated and offered for sale on the website www.parluxstore.it. eo www.parlux.it The contract is concluded exclusively through the Internet, through the CUSTOMER accessing the address www.parluxstore.it and placing a purchase order according to the procedure provided by the site itself.

The customer undertakes to read, before confirming his order, these general conditions of sale, in particular the pre-contractual information provided by PARLUX and to accept them by placing a flag in the indicated box.

In the order confirmation email, the CUSTOMER will also receive the link to download and archive a copy of these general conditions of sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.

PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER
Before concluding the purchase contract, the CUSTOMER examines the characteristics of the goods which are illustrated in the individual product sheets at the time of the choice by the CUSTOMER.

Before validating the order with “payment obligation”, the CUSTOMER is informed of:

  • total price of the goods including taxes, with details of shipping costs and any other costs;
  • payment method;
  • conditions, terms and procedures for exercising the right of withdrawal (section RIGHT OF WITHDRAWAL of these conditions)
  • information that the CUSTOMER will have to bear the cost of returning (shipping costs) the goods in the event of withdrawal;
  • existence of the legal guarantee of conformity for the goods purchased.

The CUSTOMER may at any time and in any case before the conclusion of the contract, take note of the information relating to PARLUX, the geographical address, telephone and fax number, e-mail address, information which is also reported below:

CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
The sales contract is considered concluded with the online confirmation and payment of the same. Parlux will also send the CUSTOMER an order confirmation email. The email contains the CUSTOMER's data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the link to print and archive a copy of these conditions.

The CUSTOMER undertakes to verify the accuracy of the personal data entered and of those contained in the email above and to promptly communicate to PARLUX any corrections/modifications to be made.

PARLUX is committed to describing and presenting the items sold on the site in the best possible way. However, some errors, inaccuracies or small differences between the product depicted on the site and the actual product may arise. Furthermore, the photographs of the products presented on www.parluxstore.it do not constitute a contractual element, as they are to be considered only representative.

PARLUX undertakes to deliver the goods within 30 days from the date PARLUX sends the order confirmation email to the CUSTOMER.

PRODUCT AVAILABILITY
Product availability refers to actual availability at the time the CUSTOMER places the order. However, this availability must be considered purely indicative as:

  • the products could be sold to other CUSTOMERS before the order is confirmed, due to the simultaneous presence of multiple users on the site.
  • a computer anomaly could occur that makes a product available for purchase that in reality is not.

Even after sending the order confirmation email sent by PARLUX, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically/manually corrected by eliminating the unavailable product or products and the CUSTOMER will be immediately informed by email; with this email the customer will also be informed of the methods and timing of reimbursement of any sums paid.

PAYMENT METHODS
All payments by the CUSTOMER may only be made using the credit cards indicated on the website www.parluxstore.it, by bank transfer, or by cash on delivery.

Communications relating to payment and the data communicated by the CUSTOMER when this is carried out take place on special protected lines. The security of payment by Credit Card is guaranteed by VBV (Verified by VISA) and SCM (Security Code Mastercard) certification.

BANK TRANSFER INSTRUCTIONS
Subject of the bank transfer: "PAYMENT ORDER N. --- OF dd/mm/yyy" by entering the order number that you will find in the confirmation email/in the user's personal area by accessing the order details.

The order will be processed as soon as the transfer has been credited.

For cash payments (cash on delivery) a cash on delivery fee of €3 is always added.

PRICES AND SHIPPING COSTS
All sales prices of the products indicated on the website www.parluxstore.it are expressed in Euros and include VAT and, where applicable, the WEEE contribution.

The CUSTOMER accepts the right of PARLUX to modify its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time of creation of the order and indicated in the confirmation email sent by PARLUX to the CUSTOMER.

In the event of an IT, manual, technical, or any other error that may result in a substantial change, not foreseen by PARLUX, in the retail price, making it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.

Shipping costs are not included in the purchase price, but are indicated and calculated at the end of the purchase process before payment is made.

Shipping In Italy: In Italy the shipping costs are €8.50 for orders under €50.00.
For orders of at least €50.00 shipping is free.

RIGHT OF WITHDRAWAL
In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products.

The CUSTOMER who intends to exercise the right of withdrawal must communicate this to PARLUX via an explicit declaration, which can be sent via email to servizioclienti@parluxstore.it and by registered mail with return receipt to the following address:

The CUSTOMER may exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014 (not mandatory) the text of which is reported below:

In case of exercising the right of withdrawal, the CUSTOMER is required to return the goods within 14 days from the day on which he communicated to PARLUX his intention to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.

The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, PARLUX will refund the amount of the products subject to withdrawal plus the shipping costs of the first shipment within a maximum of 30 days.

Parlux, before accepting the return, reserves the right to request photos to demonstrate the perfect integrity of the item you wish to return.
Once Parlux receives the goods and checks their perfect integrity, the aforementioned company will proceed with the refund within and no later than 30 days.

For the return and shipment of the product, the Customer is free to use a courier of his choice, for which he will bear the costs.

It is understood that in the event of a product defect, shipping costs will in any case be borne by PARLUX.

As provided for by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, PARLUX may suspend the refund until receipt of the goods or until the CUSTOMER has demonstrated that the goods have been returned to PARLUX.

PARLUX will refund the CUSTOMER by bank transfer. The CUSTOMER who intends to exercise his right of withdrawal, must provide PARLUX, by email to servizioclienti@parluxstore.it, the bank details (IBAN, SWIFT and BIC) necessary for the refund to be made by PARLUX.

WARRANTY
The provisions of the law regarding guarantees apply to purchases made by Consumers, including, if applicable, the provisions set forth in the Consumer Code regarding guarantees for consumers.

In the event of receiving defective products or products that do not conform to the orders placed, the CUSTOMER has the right to restore the conformity of the product without charge by repairing or replacing the product. The CUSTOMER can exercise this right if the defect occurs within two years of delivery of the goods and reports the defect to PARLUX within two months of discovery.

In order to exercise the above right, the customer must send an email to info@myparlux.it, specifying the defect found. PARLUX, in the event of a defective or non-compliant product, will, at its own expense, organize the collection of the product, compatible with the availability of the CUSTOMER.

To benefit from warranty assistance, the CUSTOMER must keep the invoice which can be printed by accessing the "My orders" section of the "Reserved Area" space.

It is expressly understood that the above warranty conditions will not apply in the event of defects found in Products purchased by Professionals / VAT Numbers / Companies. In this case the warranty is for six months starting from the date of purchase.

DELIVERY METHODS
PARLUX will only accept orders to be delivered in Italy, the Republic of San Marino and the Vatican City. The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of ordering within and no later than 30 days from the date of receipt by the CUSTOMER of the order confirmation email sent by PARLUX.

For each order placed on the website www.parluxstore.it, PARLUX issues an invoice for the goods shipped. The invoice is available and printable, after the order has been processed, in the "My orders" section of the "Reserved Area" space of the CUSTOMER. The invoice will contain the information provided by the CUSTOMER during the purchase procedure. After the invoice has been issued, it will not be possible to make any changes to the data indicated in the invoice.

Upon delivery of the goods by the courier, the Customer is required to check: a) that the number of packages delivered corresponds to that indicated in the transport document/invoice; b) that the packaging is intact, not damaged, not wet or in any way altered, including the sealing materials (adhesive tape or plastic straps).

In case of delivery of a damaged product or a product that does not comply with the order, the customer has the option to refuse delivery (mandatory mention on the delivery note). In the absence of reservation on the delivery note, no complaint will be taken into consideration by either the carrier or PARLUX.

In the event of failure to collect the material stored in the courier's warehouses within 5 working days due to repeated impossibility of delivery to the address indicated by the Customer at the time of ordering, the order will be automatically cancelled, the courier will proceed with the return of the package to PARLUX. In this case, the customer is required to reimburse PARLUX for double shipping costs (to the customer and return to the company).

RESPONSIBILITY
PARLUX assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the internet network, in the event that it is unable to execute the order within the timeframes set out in the contract.

ACCESS TO THE SITE
The CUSTOMER has the right to access the site for consultation and purchases. No other use, in particular commercial, of the site or its content is permitted. The integrity of the elements of this site, whether audio or visual, and the related technology used remain the property of PARLUX and are protected by intellectual property rights.

COOKIES
The website www.parluxstore.it uses ''cookies''. Cookies are electronic files that record information relating to the CUSTOMER's navigation on the site (pages consulted, date and time of consultation, etc.) and that allow PARLUX to offer a personalized service to its customers.

PARLUX informs the Customer of the possibility of deactivating the creation of such files by accessing their Internet configuration menu. It is understood that this will prevent the Customer from proceeding with the online purchase.

INTEGRALITY
These General Conditions of Sale are constituted by all the clauses that compose them. If one or more provisions of these General Conditions of Sale are considered invalid or declared as such pursuant to the law, regulation or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.

APPLICABLE LAW AND JURISDICTION
These General Conditions of Sale are subject to Italian law.

Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the Court of the customer's residence or, in its absence, of the Court of Milan.

Posso avere un asciugacapelli Parlux con voltaggio universale?

No. Al momento gli asciugacapelli Parlux prodotti per il mercato italiano con voltaggio 220v, non possono essere utilizzati in qualsiasi altro territorio internazionale che utilizzi un voltaggio diverso (ad esempio 110v), neanche munendosi di adattatore. Questo perché la potenza del prodotto Parlux è molto elevata e un semplice trasformatore non è in grado di convertire la corrente del phon da 220v a 110v.

Vorrei diventare un vostro distributore diretto, come posso fare?

È normale che quando accendo l'asciugacapelli Parlux vedo una piccola scintilla all'interno dell'interruttore?

Si. Lo "scintillio" che si nota nella commutazione dei tasti è un effetto normale che si verifica in tutti i contatti elettrici. In questo caso la commutazione avviene all'interno dell'involucro isolante dell'interruttore che a sua volta è inglobato dal manico dell'asciugacapelli anch'esso in materiale isolante plastico (infatti l'asciugacapelli è in doppio isolamento). Essendoci tra le due parti una piccolissima fessura, lo scintillio, a volte è visibile anche all'esterno, ma a livello sicurezza non ci sono assolutamente problemi.

L'unico accorgimento, come da istruzioni per tutti i tipi di contatti elettrici, è di non utilizzare l'asciugacapelli con le mani completamente bagnate e naturalmente utilizzarlo lontano dall'acqua.

Perchè dovrei scegliere Parlux?
